Welcome to onlinewatersports.gr the following Terms of Use govern your access to and use of the website/platform onlinewatersports.gr, regarding the services provided through the website by onlinewatersports. By using the website and creating an account on it, whether as a business or as a buyer, it is assumed that you have read and understood the Terms of Use. Therefore, before starting to use it, you are required to accept the relevant terms by clicking on the option “Accept Terms of Use,” thereby committing to the rights and obligations described. If you do not wish to accept the Terms of Use, please be advised that you cannot use or access the website. The company reserves the right to modify these Terms of Use by posting a copy on the website. Users who continue to use the website after the change of the Terms of Use are deemed to have accepted them.

GENERAL TERMS

The use of the website and the creation of an account are free and allowed only for adult individuals, according to Article 127 of the Civil Code (those who have reached the age of 18). If you use the website, you guarantee that you are an adult and have legal capacity, according to the provisions of the Civil Code.

During your visit to the website and the account creation process, you may be asked to provide your personal information (name, surname, profession, email address, beach location, etc.) in order to provide the services through the platform. The aforementioned personal data is exclusively stored by the website for transaction security, order processing, and improvement of the services provided through it. Their use by third parties or their transfer to third parties without your prior explicit consent is prohibited (except in cases explicitly provided by law).

In any case, the storage and processing of your personal data are carried out by specific authorized personnel of the company and are governed by the European Regulation 2016/679 for the protection of natural persons regarding the processing of personal data, the Data Protection Act 2018, which incorporates the Regulation into English law, and Law 4624/2019, which incorporates the Regulation into Greek law. However, the company bears no responsibility for electronic attacks and unauthorized access to users’ personal information by hackers.

Technical user support is available 24/7 to ensure their security. Customer support operates from Monday to Friday, 09:00-17:00. The company does not provide any protection for users who conduct transactions outside the platform. Any transaction must be conducted exclusively through the platform.

The company is not responsible for the quality of the services provided through the website.

The company will respond to specific and well-founded complaints regarding the violation of intellectual property rights or trademarks.

If users evaluate, comment on, or submit proposals for onlinewatersports.gr as a whole, onlinewatersports exclusively retains permanent, irrevocable, and international ownership rights to these evaluations. The company is not obliged to implement the observations made by users.

The use of the website, its content, and any services acquired through it are solely the responsibility of the users. The website, its content, and the services acquired through it are provided by the platform “as is” or “as available” and without any explicit or implied warranties of any kind. Definitions:

Buyer: User who purchases services or submits a request to receive a specific service through onlinewatersports.gr.

Rating: Comment placed on a business profile by a buyer after completing an order, accompanied by a rating for the quality of the service. The business has the option to provide a response comment on a buyer’s profile in response to the buyer’s comment.

Disputes: Any disagreements that arise between a buyer and a business during the execution of a reservation through onlinewatersports.gr.

Level: Configured for each business profile, based on the reservations it has undertaken and the overall rating of its profile.

Order: The final agreement between a buyer and a business for the execution of an activity, which may involve the provision of one of the services available through onlinewatersports.gr.

Commission: A fee of 15% automatically deducted from each completed order, as consideration for the provision of services by onlinewatersports.gr. The commission percentage may vary depending on the business’s level and the specific agreement reached with the business (e.g., subscription during a promotional period). This specific amount may also change at any time at the discretion of onlinewatersports.gr. In the event of a change, the business will be promptly notified and will have the option to terminate the collaboration if it disagrees with the change in the amount.

Profile: The account created by a user, as it appears on the website, containing basic information about the user.

Payment System: Use of any credit/debit card (MasterCard, Visa, American Express) through the Stripe system or other applications, or through the secure PayPal page.

Users: The businesses and buyers who create an account/profile on the website for the provision and purchase of services through onlinewatersports.gr.

Business: A company engaged in the field of water sports and marine transportation, independently promoting the services it provides through onlinewatersports.gr.

USERS

By creating an account on onlinewatersports.gr, users are required to read and accept the current Terms of Use. The account information is kept anonymous. However, users must provide accurate details and complete their information without misleading, offending, or causing harm in any other way. onlinewatersports.gr reserves the right to request confirmation of user information.

If users act with the intention of defaming competitive businesses by placing orders from competing services, onlinewatersports.gr will withdraw their reviews or take further actions regarding the status of their account.

The use of the website in a manner that violates the Terms of Use, including but not limited to the following actions, is prohibited:

  • Offering illegal or fraudulent services.
  • Creating a fake account using false personal information on behalf of another user.

In case of violation of the Terms of Use and the occurrence of any of the above behaviors, the company reserves the right to disable the user/offender’s account.

BUSINESSES

  • The contracting company, may create its profile on the onlinewatersports.gr platform, in order to facilitate prospective customers/buyers to get to know its services and offers and to purchase its services.
  • By offering to provide a service, the business undertakes to have necessary licenses and legal rights to provide, sell or resell the service offered through the platform.
  • The business is subject to any withholdings, made by their bank, when depositing into their bank account.
  • Clients-buyers will pay the agreed amount-cost of the services that the other contracting company will agree to offer them, directly to the platform/company on account or in the way that the latter will indicate to them.
  • A maximum of one (1) time per month, the platform releases payments to the business, via PayPal, Stripe or bank deposit, deducting a commission of fifteen percent (15%) ) for the provision of its services. The above percentage may vary depending on the agreement.
  • The platform to protect its reputation and name, reserves the right to remove certain service offers, published by the company, due to general, ambiguous or inaccurate information in their description, in order to protect the buyer.
  • The platform also reserves the right to disable the company’s services on the platform if the latter has become inactive.
  • The business accepts the platform/company as an intermediary for processing payments, agreeing to the terms of use, as listed in this private agreement. By accepting the responsibility of the platform/company, as a limited authorized agent for the collection of payments, the platform/company and its partners, do not assume any responsibility for any actions or omissions of the company.
  • On one hand, the contracting company is solely and exclusively responsible for ensuring sufficient civil liability insurance to the customers-buyers of its services through the platform, so that it covers with the amount of the fee all the risks involved in the provision of its services. It goes without saying that it is solely responsible and accountable for the quality and hygiene and safety of the marine leisure services provided by it.
  • On the one hand, the contracted platform/company bears no responsibility for the reliability and quality of the provision of the services of the other contracted company, nor does it in any way assume the position of guarantor for the quality and safe provision of these services and in general transactional behavior of the counterparty.
  • After the order is completed and the payment is released, the platform/company undertakes to issue and send the legal documents to the buyers, on behalf of the business.
  • Applicable law, regardless of the headquarters or nationality of the members or partners of the contracting company on the other hand, is defined as Greek.
  • For any dispute or conflict that may arise during the implementation of this, it is expressly agreed that the Courts of Chania, Crete are competent.

BUYERS

  • Buyers accept, with these Terms of Use, the company as an intermediary for making a payment. In accepting its responsibility as a limited authorized agent for the collection of payments, the company and its associates assume no responsibility for any acts or omissions of the seller.
  • Once the company completes the reservation, the Buyer has a period of three (3) days before the reservation, to request any modification to the order.
  • Payment from the Buyer to the business is made either using any credit/debit card (MasterCard, Visa, American Express) through Stripe or through the secure PayPal page. In addition, you automatically receive a transaction confirmation email from onlinewatersports.gr.
  • After the completion of the order and the release of the payment, the company undertakes the issuing and sending of the legal documents to the Buyers, on behalf of the businesses.
  • Service charges are added at the time of purchase of an offer, at which time the Buyer can see and accept the total amount required to pay, including administrative charges and website operating costs, which amounts to 15% of the amount of the completed order.

RESERVATIONS

By creating a reservation, an email is sent to both the business and the Buyer.

As soon as the Buyer makes a reservation, the company is notified both by e-mail, to the e-mail address that he has indicated during registration, and as soon as he logs into his account.

The release of payment to the business is done by onlinewatersports every Sunday.

COPYRIGHT

The company reserves the right to remove or delete material where copyright infringement is suspected.

PAYMENTS

  • The services of onlinewatersports.gr are provided free of charge to users. However, a 15% commission is deducted from each completed order.
  • Payment for the provision of services, through the platform, can be made either by using any credit / debit card (MasterCard, Visa, American Express) through Stripe or through the PayPal system.
  • Both the Stripe system and the Paypal system are used by onlinewatersports.gr as escrow systems, so the company acts as an intermediary in the payment. To this end, the company is not taxed for the provision of services to the Buyers, as the payment amount is automatically transferred from the Buyer to the company. It is taxed, however, in accordance with the existing tax provisions for the provision of the company’s services to businesses.
  • Businesses acknowledge that onlinewatersports acts as an authorized payment agent solely to accept payments made through the Platform by the Buyer and remit such payments to the business. The company accepts that payment by the Buyer to onlinewatersports.gr is equivalent to payment directly to him. The Buyer’s obligation to pay the business is achieved upon receipt of payment by the company and the company is responsible for sending the fees to the business, in accordance with these Terms of Use. In the event that the company does not send the relevant percentages to the company, the company has the right of appeal only against it and not against the Buyer directly.
  • Regarding the payment process, Buyers, both during their cooperation with a company and after the completion of the order, are secured in the following ways:
  • If the company fails to process the reservation, within the set deadline the Buyer has the right to request a full refund by sending a request to the Problem Resolution Center. In the event of a business dispute, the case is resolved by the Problem Resolution Center team. In this case, onlinewatersports is not responsible for the time that elapses until the Buyer’s bank shows the amount of the fee returned to the customer’s account.
  • The company is not responsible for the completion of the payment, in case of entering an incorrect or invalid PayPal ID by a business. The business must contact PayPal to resolve the matter.
